Took place on August 30, 1995 at the Eldridge's residence 554 Monroe Street. The Garcia family has a document video and audio tape of that day. The Garcia family lives directly across the street of 554 Monroe Street. The Garcia's residence is 563 Monroe Street.
The Eldridge family had told all the neighbors that they have a restraining order against Rudolph O. Garcia. The Eldridge family had told the neighbors that Rudolph is not to keep them under surveillance. The Eldridge family had violated the restraining order #67795 since December, 14, 1993 to April 14, 1998. The Honorable Judge WINTON MCKIBBEN, HAD SAID THAT YOU CANNOT GO AND TALK ABOUT ONE ANOTHER TO ANYONE.
The Eldridge family had told the neighbors that, the restraining order case number 67795 was not a "MUTUAL" restraining order. The restraining order 67795 was a "MUTUAL" order. And that both parties are to stay away from each other at least 25 yards. The Eldridge family has been parking their vehicles less than ten feet away from Rudolph O. Garcia's residence. From the beginning of December, 14, 1993 Rudolph O. Garcia had called the Napa Police department. Rudolph had told Officer Don Honey that Leroy is parking his truck right next to his property, less than 25 yards. Officer had asked Rudolph O. Garcia if there were any witnesses that had seen the violation. Rudolph O. Garcia, said no. Officer Honey said to Rudolph O. Garcia, that he should buy a camcorder to record the violations.
THE ELDRIDGE FAMILY IS AWARE OF THE “MUTUAL “RESTRAINING ORDER NUMBER 67795. THE ELDRIDGE FAMILY DECIDED TO PLAN AND USE THE NEIGHBORS TO GO AGAINST THE GARCIA FAMILY. THE ELDRIDGE FAMILY KNEW THEY WERE VIOLATING THE RESTRAINING ORDER NUMBER 67795.
THE ELDRIDGE FAMILY KNEW THE GARCIA FAMILY WOULD TAKE PICTURES AND VIDEO AND AUDIO TAPE THEIR VIOLATIONS. THE ELDRIDGE FAMILY’S PLANS WERE TO CONSPIRE WITH THE NEIGHBORS AND LOCAL LAW OFFICIALS AS LEROY HAD STATED BACK IN DECEMBER 2, 1993. NAPA POLICE REPORT CASE NUMBER 93-11446.
NAPA DEPUTY DISTRICT ATTORNEY MIKI TAL HAS DROPPED ALL OF OUR CASES. SHE HAD STATED TO THE GARCIA FAMILY THAT SHE DOES NOT LOOK AT THE VIDEO AND AUDIO TAPES. SHE SAID I ONLY READ THE POLICE REPORTS.
Around September of 1995, Rudolph O. Garcia’s son Perfecto B. Garcia had turned in a report of twenty violations. Along with three video and audio tapes as documents of violations of the Eldridge family. Deputy District Attorney RAY SCHAAL had sent a letter to both parties, explaining that three Deputy District Attorneys had reviewed the Eldridge and Garcia complaints. They could not come up with a Conclusion of these violations.
On or about June 14, 1996 in the County of Napa, State of California, the crime of DISOBEYING COURT ORDER in violation of section 166(A) (4) of the Penal Code, a Misdemeanor, was committed by Rudolph O. Garcia, who did willfully and unlawfully commit Contempt of court by willful disobedience of a process and order lawfully issued by a court,
To wit, kept plaintiff and family members under surveillance.
